Join the fight against the beach closure to naturism/nudism
From Daring Beginnings to Common-Sense Protection.
For decades, Sandy Bay has lived as Cape Town’s worst-kept secret and most iconic clothing-optional stretch of coast. Its history stretches back to the 1940's with stories of adventurous Boy Scouts who stripped off to brave the cold Atlantic waters. The remoteness, yet proximity to Cape town made for what became a sanctuary for naturists, nature lovers locals, and LGBTQ+ beachgoers seeking a safe haven to unwind without judgment under the African sun.
However, because authorities chose to turn a blind eye to Sandy Bay for so many years rather than properly manage it, a dangerous enforcement vacuum formed. Being left strictly "off the record" came at a heavy cost to regular beachgoers:
Rampant Crime & Muggings: Isolated access paths along the coast became hotbeds for opportunistic thieves targeting vulnerable, unsuspecting visitors.
Theft of Personal Belongings (Including Clothes): Bathers returning from the surf frequently found their bags, wallets, cellphones, and even their clothes stolen right off the sand—leaving victims literally stranded naked.
Voyeurism & Harassment: Unregulated access allowed voyeurs and unauthorized camera drones to operate without consequence.
Unclear Boundaries: Without official signage, local hikers, tourists, and beachgoers constantly collided over mismatched expectations.
The situation reached a breaking point on 7 September 2026, when SANParks and local community watch groups put up formal warning signs at the beach entrances. Reading "No Nudity and/or Sexual Misconduct in any open public space, including beaches and pathways" and threatening fines alongside drone surveillance, the new boards abruptly placed decades of local culture under threat of heavy-handed prohibition.
The notice cites Section 19(2) of the Sexual Offences Act 23 of 1957, a legacy statute that penalizes anyone who "willfully and openly exhibits himself or herself in an indecent dress or manner" in a public place. However, applying this law directly to peaceful, non-sexual naturism incorrectly conflates simple nudity with sexual misconduct or lewdness. South African jurisprudence and constitutional standards have long established that for public nudity to constitute an offence under indecency laws, there must be a proven element of sexual intent, lewdness, or deliberate public nuisance designed to cause distress. Under South Africa’s 1996 Constitution—specifically the Bill of Rights guarantees to human dignity (Section 10), personal freedom and bodily integrity (Section 12), and freedom of expression and lifestyle (Section 16)—peaceful naturism practiced in a traditional, isolated natural setting like Sandy Bay is not an inherently criminal act, but rather a protected expression of personal liberty and bodily autonomy when conducted respectfully without sexual behavior or intent
Simply banning nudity and threatening it with a law doesn't address the core problem. Pushing law-abiding naturists out won't magically solve crime along the trail—it only strips away the peaceful community that kept an eye on the space.
Our Call to Action: Formal Regulation, Not Blanket Bans
We urge the City of Cape Town, SANParks, and relevant stakeholders to move past decades of neglect and blanket prohibitions. We call for the formal recognition and regulation of Sandy Bay as a designated naturist beach.
Proper regulation provides the exact structure needed to address both safety and freedom:
1. Active Crime Prevention & Security: Formal recognition brings structured patrols, clear emergency contacts, and active safety monitoring along access paths to stop muggings and theft.
2. Clear Behavioral Standards: Strict, enforceable bylaws banning sexual misconduct, public indecency, and aggressive behavior.
3. Privacy Protections: Enforceable bans on non-consensual photography, filming, and unauthorized drone surveillance to safeguard beachgoers.
4. Transparent Boundaries: Proper signage at entry routes (from Llandudno and Hout-Bay) informing general visitors of the beach's designated status so everyone knows what to expect.
Cape Town is a progressive, world-class destination celebrated for its diversity and natural freedom. It is time for authorities to step up, replace negligence with accountability, and secure Sandy Bay as a safe, respectful, and well-managed coastal space for everyone.
